CONSIGNMENT AGREEMENT
Made between:
Consignee LA BAZARO community market
AND Consignor.
Whereas the Consignor wishes to sell certain items (“Consigned Items” listed) on consignment via the Consignee, it is agreed:
1. Sale by Consignment: The Consignor places the Consigned Items in the care of Consignee for purpose of sale, under the prices listed;
2. Ownership: Title and ownership of all the Consigned Items shall remain with the Consignor until such time as their sale or removal under this Agreement;
3. Commission: It is agreed that the Consignor will receive the sale price elected for each Consigned Item as credit to their consignor account, minus a 20% commission which will be collected by the Consignee;
4. Payment: Upon sale of any Consigned Item the Consignor may collect any credit on their consignor account, via cash in local currency, electronic funds transfer, or use as credit against the sale of any items sold by the Consignee.
5. Risk of Loss: All risk of loss in the Consigned Items shall be upon the Consignee, who will pay the Consignor the sale price minus commission for any lost, damaged or destroyed Consigned Item owned by the Consignor.
6. Right to Inspect or Change Price: The Consignor may examine any of their Consigned Items, or change their sale price, at any time or location the Consignee offers the Consigned items for sale;
7. Removal of Products: The Consignor may, at any time before sale, and for any reason, take possession of and remove any Consigned Item they own from this Agreement;
8. Governing Law: This Agreement shall be construed and enforced according to the laws of the Province of Ontario, Canada and any dispute must be brought in this venue and no other.
9. Version precedence: In the event of any conflict or inconsistency between the English language version of this Consignment Agreement and any translated version, the English language version shall prevail for the purpose of interpreting this Consignment Agreement.
Both Consignor and Consignee agree to the terms of this Consignment Agreement for the Consigned Items listed on the receipt printed and signed at the time of consignment.
